The goal is to improve responsible gambling regulations through data aggregation

West Virginia lawmakers are pushing a bill requiring gambling operators to share user data with West Virginia University (WVU) researchers. The legislation passed the first reading in the House on Monday after it advanced beyond the Judiciary Committee last week. The second reading will be on Tuesday, with a third upcoming on Wednesday.

Representative Shawn Fluharty is the co-sponsor of HB5668, along with the primary sponsor and House Speaker, Representative Roger Hanshaw. The West Virginia Responsible Gaming and Research Act (RGRA) was introduced on February 13 and would apply to all retail and online gaming operators in the state. It requires that legal operators collect anonymous player data, which must be submitted to WVU monthly, quarterly, or yearly.

A similar iGaming referendum proposed in Maryland includes data sharing with Bowie and Morgan State universities. The Minnesota Alliance on Problem Gambling (MAPG) proposed a similar guideline when the state evaluated legalizing sports betting last year.

Data sharing, as a concept, is just starting to be adopted in the US after gaining success in the European gaming market.

Fluharty also serves as president of the National Council of Legislators from Gaming States (NCLGS) and says there’s been little resistance from the industry so far. While he acknowledged this could change, he hopes gaming operators will realize the bill’s benefits.

The NCLGS is also working with the United Kingdom Gambling Commission (UKGC) to create model iGaming legislation, which would offer a regulatory framework for states contemplating legalizing online gambling. However, Fluharty says the current data-sharing measure focuses exclusively on West Virginia.
